1. Acceptance of Terms
By accessing or using the website at https://omicronmedia.wixstudio.com/my-site-8 (the "Site") or enrolling in any coaching, training, or programs offered by Diane's Golf Academy ("we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Site or services.
These Terms apply to all visitors, clients, and others who access our Site or participate in our programs, including Junior Coaching, Adult Coaching, and Performance Training.
 
2. Services Offered
Diane's Golf Academy provides golf coaching and training services, including but not limited to:

• Junior Coaching programs for young golfers

• Adult Coaching sessions for recreational and competitive golfers

• Performance Training for advanced and competitive players

• Coaching assessments and individualized program design

 
All services are subject to availability and scheduling. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Enrollment and Registration
To enroll in any of our programs, you may be required to complete a coaching assessment. By completing the assessment and enrollment process, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activities conducted through your account.
We reserve the right to refuse enrollment to any individual at our sole discretion.
 
4. Fees and Payment
4.1 Program Fees
Fees for our programs are outlined on our website or provided during the coaching assessment. All fees are subject to change without notice. Any changes to fees will not affect existing bookings already paid in full.
4.2 Payment Terms
Payment is due at the time of registration or as otherwise agreed in writing. We accept payment methods as listed on our Site. You agree to pay all applicable fees and any taxes associated with your use of our services.
4.3 Refunds and Cancellations
Cancellation requests made at least 48 hours prior to a scheduled session may be eligible for a full refund or credit at our discretion. Cancellations made within 48 hours of the scheduled session may not be eligible for a refund. No-shows without prior notice will be charged in full. We reserve the right to cancel or reschedule sessions due to weather, instructor unavailability, or other circumstances beyond our control, in which case a full refund or rescheduling will be offered.
 
5. Code of Conduct
All clients and participants are expected to conduct themselves in a respectful and professional manner at all times. We reserve the right to terminate any session or enrollment, without refund, if a participant's behavior is deemed unsafe, disrespectful, or disruptive. This includes, but is not limited to:

• Verbal or physical harassment of staff, instructors, or other participants

• Damage to equipment or facilities

• Failure to comply with safety guidelines or instructor directions

 
6. Health, Safety, and Assumption of Risk
Golf involves physical activity and carries an inherent risk of injury. By participating in any of our programs, you voluntarily assume all risks of injury, illness, or harm that may result from your participation, including risks arising from the negligence of our staff, provided such risks are an ordinary and foreseeable part of golf instruction.
You represent that you are in adequate physical health to participate in golf coaching. If you have any medical conditions, injuries, or physical limitations, you agree to disclose these to your instructor prior to beginning any program. We strongly recommend consulting a physician before beginning any new physical activity program.
Parents or guardians are responsible for ensuring that minor participants are medically fit to participate and must sign any required waiver or consent forms on behalf of minors.
 
7. Liability Waiver and Limitation of Liability
To the fullest extent permitted by applicable law, Diane's Golf Academy, its owners, instructors, agents, and employees shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your participation in our programs or use of our Site, including but not limited to personal injury, property damage, loss of data, or financial loss.
You agree to indemnify and hold harmless Diane's Golf Academy, its affiliates, officers, instructors, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of or related to your use of our services or your violation of these Terms.
 
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, audio clips, and training materials, is the property of Diane's Golf Academy or its content suppliers and is protected by applicable intellectual property laws.
